These essays showcase the value of the narrative arts in investigating complex conflicts of value in moral and political life, and explore the philosophical problem of moral dilemmas as expressed in ancient drama, classic and contemporary novels, television, film, and popular fiction. From Aeschylus to Deadwood, from Harriet Beecher Stowe to Harry Potter, the authors show how the narrative arts provide some of our most valuable instruments for complex and sensitive moral inquiry.

The chapters in this volume address a variety of issues surrounding quotation, such as whether it is a pragmatic or semantic phenomenon, what varieties of quotation exist, and what speech acts are involved in quoting. Quotation poses problems for many prevailing theories of language. One fundamental principle is that for a language to be learnable, speakers must be able to derive the truth-conditions of sentences from the meanings of their parts. Another popular view is that indexical expressions like "I" display (...) a certain fixity -- that they always refer to the speaker using them. Both of these tenets appear to be violated by quotation. This volume is suitable for scholars in philosophy of language, semantics, and pragmatics, and for graduate students in philosophy and linguistics. We invoke a triple rationale to rebut Hooper and Spicer's argument against mandatory helmet laws. First, we use the laws of physics and empirical studies to show how bicycle helmets afford substantial protection to the user. We show that Hooper and Spicer erroneously downplay helmet utility and that, as a result, their attack on the utilitarian argument for mandatory helmet laws is weakened. Next, we refute their claim that helmet legislation comprises unjustified paternalism. We show the healthcare costs of bareheaded (...) riding to pose significant third party harms. It follows, we argue, that a utilitarian case for helmet laws can be sustained by appeal to Mill's Harm Principle. Finally, we reject Hooper and Spicer's claim that helmet laws unjustly penalise cyclists for their own health-affecting behaviour. Rather, we show their argument to suffer by disanalogy with medical cases where injustice may be more evident, for example, denial of bypass surgery to smokers. We conclude that mandatory helmet laws offer substantial utility and are entirely defensible within the framework of a liberal democracy. (shrink)

This chapter presents a synopsis of the historical evidence concerning the expansion of slavery and the trade in ivory during the Turco-Egyptian era in the Sudan between 1820 and 1881, and a description of the results of recent and very preliminary archaeological investigations at three sites associated with this trade around the town of Rumbek in Lakes State, South Sudan. The chapter begins with a brief review of the establishment of Ottoman rule in Egypt, before moving on to consider the (...) broader geopolitical forces that gave rise to the decision by the Egyptian Khedive, Mehmed Ali, to invade Sinnar, Kordofan and adjacent areas of northern Sudan. It then discusses the economic consequences and legal changes following the establishment of Turco-Egyptian rule that helped create the conditions for the expansion of slaving expeditions into southern Sudan and the establishment of a series of fortified camps or zaribas in these areas. Culture and Enlightenment are the two words that best characterise the essence of György Markus's career, in whose honour this book is published. Markus devoted the last twenty years of research towards a theory of cultural objectivations and their pragmatics, and the great depth of his knowledge of the history of culture and philosophy informs all his teaching and writing. The pursuit of Enlightenment ideals attains reflective self-consciousness in Markus' works; forged in the knowledge of its own historicity, of the (...) embeddedness of rationalities in culture and in an awareness of the paradoxes that cling to the conscious affirmation of ideals which are no longer self evident or beyond questioning. In taking up the challenge of these paradoxes, Markus spans the whole history of modern philosophy and culture with a matchless authority.This book draws together contributions from leading figures in contemporary philosophy, who are also friends, colleagues and former students of György Markus. The book is divided into two sections: the first presents critical assessments of various aspects of Markus' wide-ranging works; the second presents contributions in celebration of his influence and his wide interests. As a 2006 Institute of Medicine report highlights, surprisingly little empirical attention has been paid to how prisoners arrive at decisions to participate in modern research. With our study, we aimed to fill this gap by identifying a more comprehensive range of factors as reported by prisoners themselves during semistructured interviews. Our participants described a diverse range of motives, both favoring and opposing their eventual decision to join. Many are well-recognized considerations among nonincarcerated clinical research participants, including a desire for (...) various forms of personal benefit, altruism, and concern about study risks and inconveniences. However, a number of influences seem unique to prisoners. Participants did not report that they were not coerced into enrolling, and they have even been under pressure not to enroll. However, many sought to enroll in order to obtain access to better health care, raising a concern about whether they were unfairly exploited. (shrink)

Background: Therapeutic misconception, the misunderstanding of differences between research and clinical care, is widely prevalent among non-incarcerated trial participants. However, little attention has been paid to its presence among individuals who participate in research while incarcerated. Methods: This study examined the extent to which 72 incarcerated individuals may experience therapeutic misconception about their participation in one of six clinical trials, and its correlation with participant characteristics and potential influences on research participation. Results: On average, participants endorsed 70% of items suggestive (...) of therapeutic misconception. The tendency toward therapeutic misconception was significantly higher among African Americans and Latinos compared to Whites, among older and less educated participants, and among enrollment in a substance-abuse-related trial; it was also correlated with a belief that the trial was the only way to obtain needed treatment. Conclusions: Therapeutic misconception may be particularly high among select incarcerated individuals and is associated with a perceived lack of treatment options. Further examination of therapeutic misconception among incarcerated research participants is needed. (shrink)

This article outlines a theory of naive probability. According to the theory, individuals who are unfamiliar with the probability calculus can infer the probabilities of events in an extensional way: They construct mental models of what is true in the various possibilities. Each model represents an equiprobable alternative unless individuals have beliefs to the contrary, in which case some models will have higher probabilities than others. The probability of an event depends on the proportion of models in which it occurs. (...) The theory predicts several phenomena of reasoning about absolute probabilities, including typical biases. It correctly predicts certain cognitive illusions in inferences about relative probabilities. It accommodates reasoning based on numerical premises, and it explains how naive reasoners can infer posterior probabilities without relying on Bayes's theorem. The rapid implementation and continuing expansion of forensic DNA databases around the world has been supported by claims about their effectiveness in criminal investigations and challenged by assertions of the resulting intrusiveness into individual privacy. These two competing perspectives provide the basis for ongoing considerations about the categories of persons who should be subject to non-consensual DNA sampling and profile retention as well as the uses to which such profiles should be put. This paper uses the example of the current (...) arrangements for forensic DNA databasing in England and Wales to discuss the ways in which the legislative and operational basis for police DNA databasing is reliant upon continuous deliberations over these and other matters by a range of key stakeholders. We also assess the effects of the recent innovative use of DNA databasing for “familial searching” in this jurisdiction in order to show how agreed understandings about the appropriate uses of DNA can become unsettled and reformulated even where their investigative effectiveness is uncontested. We conclude by making some observations about the future of what is recognized to be the largest forensic DNA database in the world. (shrink)

Human experts are the source of knowledge required to develop computer systems that perform at an expert level. Human beings are not, however, able to reliably express what they know. As a result, experts often develop non-authentic accounts of their own expertise. These accounts, here termed reconstructed methods of reasoning, lead to computer systems that perform at a high level of proficiency but have the disadvantage that they often do not reflect the heuristics and processing constraints of a system user. (...) Reconstructed methods of reasoning are compared with authentic methods derived from the study of expert human behavior. Tests are proposed to establish the authenticity of reasoning methods and examples from medical diagnosis are used to illustrate how authentic methods of reasoning can be incorporated into an expert computer system. A collaborative article by the Editorial Collective of Social Imaginaries. Investigations into social imaginaries have burgeoned in recent years. From ‘the capitalist imaginary’ to the ‘democratic imaginary’, from the ‘ecological imaginary’ to ‘the global imaginary’ – and beyond – the social imaginaries field has expanded across disciplines and beyond the academy. The recent debates on social imaginaries and potential new imaginaries reveal a recognisable field and paradigm-in-the-making. We argue that Castoriadis, Ricoeur, and Taylor have articulated the most important theoretical frameworks (...) for understanding social imaginaries, although the field as a whole remains heterogeneous. We further argue that the notion of social imaginaries draws on the modern understanding of the imagination as authentically creative. We contend that an elaboration of social imaginaries involves a significant, qualitative shift in the understanding of societies as collectively and politically-instituted formations that are irreducible to inter-subjectivity or systemic logics. After marking out the contours of the field and recounting a philosophical history of the imagination, the essay turns to debates on social imaginaries in more concrete contexts, specifically political-economic imaginaries, the ecological imaginary, multiple modernities and their inter-civilisational encounters. The social imaginaries field imparts powerful messages for the human sciences and wider publics. In particular, social imaginaries hold significant implications for ontological, phenomenological and philosophical anthropological questions; for the cultural, social, and political horizons of contemporary worlds; and for ecological and economic phenomena. The essay concludes with the argument that social imaginaries as a paradigm-in-the-making offers valuable means by which movements towards social change can be elucidated as well providing an open horizon for the critiques of existing social practices. The debate on the value of Boyer's minimally counter-intuitive theory continues to generate considerable theoretical and empirical attention. Although the theory offers an explanation as to why certain cultural texts and narratives are particularly well conveyed and transmitted, amidst society and over time, conflicting evidence remains for any mnemonic advantage of minimally counter-intuitive concepts. In an effort to reconcile these conflicting results, Barrett has made a comprehensive attempt in presenting a formal system for quantifying counter – intuitiveness including a distinction (...) between counter-intuitive and counter-schematic concepts. The present article uses this system to generate sentences containing different levels of counter-intuitiveness, and tests whether minimally counter-intuitive items show a mnemonic advantage over concepts which are more counter-intuitive or counter-schematic. Results indicate that MCI concepts hold a mnemonic advantage over counter-schematic and maximally counter-intuitive concepts but only for one-week delayed recall. Interference effects may have masked immediate recall effects. Yes-no recognition after one week delay showed almost 100% accuracy suggesting that availability of retrieval cues is the factor which determines the mnemonic advantage of MCI concepts. (shrink)

Current methods of forensic DNA profiling, based on Polymerase Chain Reaction amplifications of a varying number of Short Tandem Repeat loci found at different locations on the human genome, are regularly described as constituting the “gold standard for identification” in contemporary society. At a time when criminal justice systems in Europe and North America increasingly seek to utilize the epistemic authority of a variety of sciences in support of the apprehension and prosecution of suspects and offenders, genetic science and recombinant (...) DNA technology are often singled out for particular approbation. An investigation is presented in which a computer simulation model (DIAGNOSER) is used to develop and test predictions for behavior of subjects in a task of medical diagnosis. The first experiment employed a process‐tracing methodology in order to compare hypothesis generation and evaluation behavior of DIAGNOSER with individuals at different levels of expertise (students, trainees, experts). A second experiment performed with only DIAGNOSER identified conditions under which errors in reasoning in the first experiment could be related to interpretation of specific (...) data items. Predictions derived from DIAGNOSER's performance were tested in a third experiment with a new sample of subjects. Data from the three experiments indicated that (1) form of diagnostic reasoning was similar for all subjects trained in medicine and for the simulation model, (2) substance of diagnostic reasoning employed by the simulation model was parable with that of the more expert subjects, and (3) errors in subjects' reasoning were attributable to deficiencies in disease knowledge and the interpretation of specific patient data cues predicted by the simulation model. The work presented here investigates the process by which one group of individuals solves the problem of detecting deceptions created by other agents. A field experiment was conducted in which twenty‐four auditors (partners in international public accounting firms) were asked to review four cases describing real companies that, unknown to the auditors, had perpetrated financial frauds. While many of the auditors failed to detect the manipulations in the cases, a small number of auditors were consistently successful. Since the detection of (...) frauds occurs infrequently in the work of a given auditor, we explain success by the application of powerful heuristics gained from experience with deceptions in everyday life. These heuristics implement a variation of Dennett's intentional stance strategy, which is based on interpreting detected inconsistencies in the light of the Deceiver's (i.e., management's) goals and possible actions. We explain failure to detect deception by means of perturbations (bugs) in the domain knowledge of accounting needed to apply these heuristics to the specific context of financial statement fraud. We test our theory by showing that a computational model of fraud detection that employs the proposed heuristics successfully detects frauds in the cases given to the auditors. We then modify the model by introducing perturbations based on the errors made by each of the auditors in the four cases. The resulting models account for 84 of the 96 observations (i.e., 24 auditors × four cases) in our data. (shrink)
